If you intend to stay temporarily in New Zealand, not study or work, you may need to apply for a Visitor’s visa or permit. If you are a genuine visitor travelling to New Zealand and you are a Passport holder from the Visa-free countries listed below, you may travel to New Zealand without the need to pre-apply for a visitor visa, provided you hold outward journey air tickets and have sufficient evidence of acceptable financial support (travelers cheques, credit cards etc) at the time of your arrival in New Zealand. A visitor permit of up to 3 months from the date of your arrival (except British passport holders who are allowed a permit for 6 months) will be issued at the entry airport. These visitor permits can be extended if you desire to stay longer.
For the other countries, you have to apply for a Visitor’s Visa when you are outside New Zealand before you will be allowed to travel to New Zealand. When you are granted a permit on arrival in New Zealand, you may remain in New Zealand for up to nine months, provided you meet the requirements for funds, health and character.
Once you are in New Zealand, you must remain on a valid permit and abide by the conditions of this permit, throughout your stay in New Zealand. Your permit will allow you to remain in New Zealand as a Visitor only. It is possible to change the permit terms while in New Zealand, i.e. you decide to undertake further study of longer than 3 months, which requires you to change to a student permit. If you then decide to obtain a job, this will require the granting of a work permit. This could then ultimately lead to you qualifying for residence.
It is important to remember that applications for new permits MUST be lodged in the correct manner with Immigration New Zealand (INZ) before the expiry date shown on the permit. All permits automatically expire when the holder leaves New Zealand and a re-entry visa is required for the holder to return to New Zealand and be issued with a new permit. Visas are issued for either single entry or multiple visit entries.

There are instances where applications for visas to enter New Zealand for a special purpose, either as a visitor, student or worker, is granted if INZ considers the application presents an unacceptable level or risk. These visas are issued only to allow you to enter New Zealand for a specific purpose – this may be a family wedding, funeral or short term study program or work conference. These permits cannot normally be amended or extended in any way and the holder must leave New Zealand before the permit expiry date. INZ also have the option of requesting the payment of a bond as assurance the visitor will return to their home country.
The following people are exempt from having to obtain a temporary visa: People who hold a current return visa issued by the Government of Australia and Citizens of the following countries who will be granted on arrival, Permits or Visas up to 3 months:

Visits up to 6 months British citizens and other British passport holders who produce evidence of the right to reside permanently in the United Kingdom may visit New Zealand for up to 6 months without a visa. Effective January 2005 Visa-free visitors must show either return air tickets or tickets for travel from NZ to another country for which a visa is held or not required. Evidence of sufficient funds for personal support for the duration of the stay in NZ will also be required.

Employers have recently become more frustrated with the apparent resistance of the New Zealand Immigration Service to grant Work Visas and Permits which would assist the employment of urgently required staff. The current economic climate contributed to numerous stumble blocks and as the New Zealand Immigration fall under the Department of Labor whose primary function is to maximize the employment opportunities and safety of New Zealand resident employees, they have been required to give stronger consideration to ensuring local unemployed are not disadvantaged. This can appear that the New Zealand Work Visa/Permit policy may be seen as complex and unyielding, with discretion rarely granted. It is therefore critical that all care possible is taken with lodging your application with the relevant documentation and information required for a successful result.
In New Zealand, there are specific skill shortages that can be constant, seasonal or on the short or long term skill shortage. These are driven by demand, therefore change is inevitable. At the time off assessing your application, we can advise under which category to apply.
There are various categories under which to apply. Some fall under the Temporary category, while others may lead to New Zealand Permanent Residence. These are:

Temporary Work
This category is applicable if you have a job offer from a New Zealand employer, when you are skilled in an occupation that is in demand in New Zealand, or when you are coming to New Zealand for a particular purpose or event.
Working Holiday – this may be applicable when you are aged between 18 to 30 years.
New Zealand currently has arrangements with 30 countries allowing young people to obtain working holiday visas to travel to New Zealand to holiday and undertake work during their stay. There are annual quota limits on some countries (eg: 1000 places for China) but no limit on the numbers of people who can apply from the United Kingdom, Germany, Japan, Netherlands, Norway, Belgium, Canada, Denmark, Finland, France, Ireland, Italy, Sweden and United States of America.
Partnership Policies
INZ policy recognises a partnership relationship as one where two people are physically living together as a couple in a genuine and stable relationship. Whether a couple is married, or not, may be a consideration in determining the “genuiness” of the relationship but marriage itself is not a policy requirement. Policy does not differentiate between heterosexual or same-sex relationships and there are no English language or age requirements within partnership immigration policies. The sponsoring partner, as well as the applicant partner, must satisfy good character requirements.
There are a number of policies which allow family members to enter, and remain in, New Zealand on either a temporary or permanent basis.
Work Policy
Overseas passport holders who do not hold New Zealand residence MUST hold a valid and applicable work permit before they can work in New Zealand. There are a range of work permit policies which can be considered depending on the circumstances and only the main policies are discussed in this section:
Normal work policy requires all the following criteria to be satisfied.
- The applicant to have an offer of employment for a full time (30 hours per week) position which is in accordance with New Zealand employment law
- The applicant to have work experience and/or qualifications relevant to the position requirements
- The employer satisfies INZ, and provides evidence, that they have made a genuine attempt to locate and employ New Zealand citizens or residents for the position. This normally means the position has to have been advertised with no responses from suitable candidates. The position should also be one that New Zealanders are unable to be easily trained for
- The employer should be credible and the position financially sustainable It can be difficult to obtain work permits for positions such as those associated with customer service, cleaning, clerical, labouring and production work.
Skills shortage work policy applies to employment in a range of occupations and industries in New Zealand where there is an acknowledged skill shortage. These occupations are reviewed and updated by INZ on a regular basis and published on their website. There are two listings:
- The Immediate Skills Shortage List (ISSL)
- The Long Term Skills Shortage List (LTSSL) - also known as the absolute skills shortage list
The ISSL generally applies to regional skill shortages and positions where short term national skill shortages exist. The LTSSL applies to nationally recognised skill shortages which are expected to remain for the foreseeable future. Work permit applications supported by offers of employment for positions on the ISSL or the LTSSL are not required to be advertised. However applicants must have evidence they hold the prerequisite qualifications and/or work experience, noted as being required within the shortage lists, to undertake the position being offered.
Positions listed on the LTSSL can have additional advantages in applying for permanent residence.
Work permits cannot normally be issued for any positions payable by commissions only, or in self employment (there are exceptions) or in any position within the prostitution industry.
Work permits are endorsed to allow the applicant to work only in the position offered and only for the employer specified on the permit label. A new work permit application or a Variation of Conditions application is required to be approved to facilitate any change in the employment terms from those specified on the original permit label.
Work Permits are issued for the period of the employment offered to an initial maximum of 3 years. All applicants must meet health and character requirements.
Skilled Migrants

The objective of applying under the Skilled Migrant Category is to provide for the grant of residence to people who demonstrate the they have the skills to fill identified needs and opportunities in New Zealand and are able to transfer their accredited skills to New Zealand. They should also be able to demonstrate their ability to contribute to New Zealand both economically and socially by further demonstrating the ability to successfully settle in New Zealand.
Talent (Accredited Employer) Work Policy
Applicants must:
a. have an offer of full time skilled employment in New Zealand for a period of at least 24 months from an Accredited Employer for a salary of NZ$45,000 or more
b. be 55 years or younger
c. be able to meet registration requirements if this is required to take up the position in New Zealand.
Talent (Arts, Sports and Culture) Work Policy
In this category an applicant with exceptional talent in a particular field of art, sport or culture, aged 55 or under and holding a sponsorship may apply for a work visa or permit.

If you want to study in New Zealand, at primary, secondary or tertiary level, you may need a study visa or permit. To obtain the visa or permit, you must normally have a formal offer of enrolment from the institution, evidence of payment of the tuition fees, guarantee of accommodation and financial support for the term of your study and satisfy INZ that you are of good health and character and are genuinely intending to study.
We may be able to assist to lodge a visa and permit application in your home country or when you are in New Zealand, we can assist in lodging a permit application. For extensions, we can help if you want to continue or finish your chosen study (Certain criteria need to be met).
The New Zealand academic year is from around late January to mid December for schools and late February to early November of tertiary programmes.
Students who are enrolled in full time study, may work for up to 20 hours a week and full time during the summer holiday vacation. If you graduate from a study programme with a qualification that is recognized under the Skilled Migrant Category residence policy, you can be granted a 12 month graduate work permit. This permit allows a graduate the ability to seek, obtain and undertake work in any position with any employer without the normal requirement for a prerequisite employment offer.
There are also further opportunities for the partners of students undertaking full time postgraduate study or towards a qualification on the Long Term Skill Shortage List to be issued open work permits enabling them to work while their partner studies.

Long Term Business Visas
Who is eligible for a Long Term Business Visa?
- Business owners wishing to establish a new business or the purchase of an existing business.
- Investors wishing to purchase minimum of 25% of existing business in New Zealand.
- Apply for residence under the Entrepreneur Category
Applicants need:
- A satisfactory business plan and
- To have sufficient investment capital to establish a business together with additional funds for maintenance and accommodation of the applicant and family and
- Meet normal health and character requirements and
- Establish that they are genuinely interested in the setting up of a business in New Zealand.
- Demonstrate ownership in or managerial experience in a relevant business.
- International English Language test (IELTS) average 5 required
Business Plan
An effective business plan is essential to the success of an application under this category:
Applicants need to establish that they have sufficient capital to finance the business, have established a realistic budget, have relevant business experience, have not been involved in bankruptcy or business failure or fraud, and have carried out sufficient market research as to the establishment of the business in New Zealand.
Because of the importance of the business plan we recommend it be prepared by professionals and we are able to refer clients to appropriate professional accounting firms if so required.
Assistance can also be given to identify an existing business venture to purchase and for researching markets in New Zealand.
Important: It is essential that you have knowledge of the New Zealand Market and the requirements for doing business in New Zealand.
The documentary requirements for this visa are substantial and we recommend professional advice.
Investors will be granted a 3 year work visa and after running the business for two years applicants are eligible to apply for permanent residence status in New Zealand.
